Standard Terms and Conditions

Orders

All orders are accepted subject to our standard conditions of sale as herein printed, unless expressly accepted in writing by the Company Gap Lighting Limited. Any qualifications of these conditions in a customer’s own form must be deemed to be, and will be treated as, inapplicable and by placing an order, customers are deemed to have accepted these conditions.

Pricing

All orders received by the company will be executed subject to the prices ruling at the date of dispatch, and any price list published or not, shall not affect the right of the Company to charge for goods in accordance with this clause, save that the company will attempt to contact the customer if there is a material change in prices before proceeding with the order. Verbal quotations shall be affected by these conditions whilst written quotations will be valid for 14 days from the date of the quotation.

Terms of Payment

Payment is strictly 30 days from the end of the month of invoice subject to a credit account application approval. Buyers without a credit account will be required to pay in full by credit/debit card before any order is processed.
The Company will accept payment by cheque drawn on a UK bank account, BACS transfer or credit/debit card.
Should it be necessary for the Company to institute formal proceedings to recover unpaid accounts, then the customer will be responsible for all collection and recovery costs incurred by the Company including all court costs and legal fees.
The Company reserves the right to charge 2% interest on all overdue accounts.

Suspension and Termination of Account Facilities

GAP Lighting Ltd shall be entitled to suspend account facilities and hold delivery of orders if the customer is in breach of any of the terms and conditions stated or (in the absolute opinion of GAP Lighting) is likely to breach any terms and conditions contained herein.

Default

The Company will not be held responsible for any costs incurred under liability clauses by installers of the Company’s products in the event of an appointed purchaser failing to comply with the Company’s terms of payment resulting in a suspension of deliveries until such default is remedied.

Delivery and Performance

The company will not be liable for any loss by the purchaser, installer or user where the Company is prevented from carrying out its obligation to supply as a result of any cause beyond the reasonable control of the Company including any consequential loss or loss of profit of either the customer or their customer.

Claims

Shortages or damages in transit must be notified to the Company in writing within 24 hours of delivery.
No claims for loss or damages will be accepted by the Company after this time unless such notification would be deemed to be unreasonable in the sole opinion of the Company.

Guarantee

GAP Lighting offer a replacement 3 year warranty on all products carrying the icon-small-three symbol.
All other products are guaranteed for 12 months with the warranty commencing from the date of purchase.

Returns

No return of goods, which are not defective, will be accepted without a RETURNS ORDER NUMBER which must be obtained within 14 days of the date of the invoice.
All returns are the responsibility of the customer and will be subject to either 2 for 1 compensating order, or a handling charge of 25% which will be deducted from any credit issued.
The company will replace or refund faulty products within the guarantee period, but will not be liable for any consequential losses such as travel or installation costs.

Faulty Goods

Faulty goods will not be accepted without our Returns Order Number.
Products will be replaced if found defective in workmanship or materials.
Subject to this, all express or implied warranties or conditions are excluded, and responsibility will not be accepted for loss or damage, consequential or other, howsoever caused.

Installation

Gap Lighting recommends that all our products are installed by a suitably qualified person. The Company will not be liable in any way for any losses incurred due to the incorrect installation of any products supplied by the Company.

Specification

All illustrations and information provided are for guidance only and are subject to variation due to changes in production processes. The Company cannot guarantee that the goods supplied will be exactly as illustrated or detailed in the descriptive literature.
However, customers will be notified of any material changes affecting products ordered.

Lighting Designs and Illustrations

All lighting designs and illustrations provided are suggestions and recommendations only.
All such designs and illustrations are supplied in good faith and shall be approximate only and shall not (unless specifically agreed by GAP Lighting in writing) be guaranteed to be accurate. All such matters should be checked by the customer for accuracy and suitability and GAP Lighting accepts no responsibility or liability whatsoever.

Ownership of Goods

All goods remain the property of Gap Lighting Limited until paid for in full, however the customer will be responsible for the goods until title passes to the customer on payment of all sums due on the customer’s account.
